Since 1 January 1994, PPC has licensed its port operations and ferry service to Penang Port Sdn. Bhd.. In addition to that with effect from 1 January 1999, Penang Port Commission's jurisdiction was also extended to Teluk Ewa Terminal, Langkawi. Penang Port Commission's as a port authority and regulator continues to foster close rapport with both its licensed operators, Penang Port Sdn. Bhd. and Kedah Cement Jetty Sdn. Bhd.. As the new millennium brings new challenges, Penang Port Commission continues to undertake measures to upgrade and enhance the port facilities to meet the increasing opportunities for commercial enterprises. On 1 January 1956, the Penang Port Commission (PPC) was established under the Penang Port Commission Act, 1955, with the responsibility to operate and maintain the port and ferry facilities. Following a corporatisation exercise on 1 January 1994, the PPC has since licensed its port and ferry operations to Penang Port Sdn. Bhd. (PPSB). PPC continues to play various important roles: As a Port Authority As a Regulatory Authority As a Lessor, Licensor and Landlord As a Port Resource Center for the northern area, and As the Administrator of the Free Commercial Zone (FCZ) The efforts of PPC have resulted in the Port of Penang's elevation from a regional centre of commerce to a centre of international trade. As a Port Authority under the Penang Port Commission Act, 1955, PPC undertakes the following tasks:- execute its statutory functions. oversee the activities within the port area. license harbour pilots. control over marine activities through the Pilotage Committee in respect of the conduct of pilots, safety of harbour and marine accidents. coordinate activities of the port through the issuance of foreshore occupation licence and port conveyance permits etc. promote the development of the port. coordinate feedback system from port users. facilitate port promotion. As a Regulatory Authority under the Ports (Privatisation) Act 1990, PPC:- acts as a landlord who ensures that proper utilization of land is being done as planned. acts as a lessor who among other things, ensures that alterations are not done to the structures and port without approval from PPC and the property leased is to be used solely for the purpose as described in the agreement. acts as a licensor who issues operating licence to the operating company subject to specified conditions. establishes and monitors the performance standard of the port operator (PPSB) by virtue of the Privatisation Agreement and Clause 3 of the Licence granted to PPSB. establishes feedback system from port users with regards to the performance of the port operator. In November 1995, Parliament passed amendments to the Penang Port Commission Act, 1955. Through these amendments, the powers and jurisdiction of PPC as a Port Authority and Regulatory Authority may be extended to other ports. Effective 1 January 1999, PPC was appointed by the Government to be the Regulatory Authority. As a Regulatory Authority, PPC's role are as follows : exercise regulatory functions over the - conduct of the port facilities - running of port facilities and services - setting performance standards, standards of facilities and services - enforcement collection of port dues. conservancy role (dredging of approach channel). administration and licensing. As a Port Resource Centre for the northern area, PPC: collects all statistical data and information on port and ferry activities. supplies statistical data and information to government agencies and corporate bodies. entertains enquiries with regards to matters concerning the port. acts as a liason between private sector and government agencies with respect to port and ferry services. acts as an advisory body on matters relating to activities of the port. undertakes studies and research on activities of the port and ferry services. As the Administrator of the Free Commercial Zone (FCZ) at Butterworth Deep Water Wharves, PPC :- ensures that the perimeter of the FCZ is fenced-up with parallel fencing or wall complete with a passage for entry and exit. ensures that the fenced area and passageway entering and leaving the FCZ is lighted from 6.30 p.m. to 7.30 a.m. the following day. requires the operator to provide Custom's office and check-point at the entrance. ensures that the operator complies with the Free Zone Act 1990 and Free Zone Regulations 1991. submits Annual Report pertaining to FCZ activities and policies to the Finance Minister. ensures that the operator controls the movement of users and goods in and out of FCZ. ensures that the operator manages the operations with due consideration to the duties and interest of Customs and taxable goods kept in the FCZ. ensures that all instructions issued by the Director-General of Customs are being complied with by the operator. As the Port Authority under the Penang Port Commission Act, 1955 and Regulator under the Ports (Privatisation) Act 1990, Penang Port Commission subscribes to the vision and mission of becoming a successful Regulator for the establishment of an effective networking in the transport chain in its mission to make Penang Port the leading port in the northern region of Indonesia, Malaysia and Thailand - Growth Triangle (IMT-GT). fter more than 40 years in the business, we've learnt that there's more to a port than just ships docking and disembarking.
