PRESCRIPTION OF POLLUTANTS 3. For the purposes of Part XV of the Canada Shipping Act, the substances listed in Schedule I are prescribed to be pollutants, except when they are carried in packaged form or in freight containers, portable tanks or road or rail tank wagons. Prohibition 4. (1) Subject to section 5, no ship shall discharge a pollutant listed in Schedule I into any of the following waters: (a) Canadian waters south of the 60th parallel of north latitude; (b) Canadian waters north of the 60th parallel of north latitude that are not within a shipping safety control zone prescribed pursuant to the Arctic Waters Pollution Prevention Act; and (c) fishing zones of Canada described in section 16 of the Oceans Act and prescribed under paragraph 25(b) of that Act. (2) Subject to section 5, no person shall discharge or permit the discharge of a pollutant listed in Schedule I from a ship into any of the waters described in paragraphs (1)(a) to (c). 5. A pollutant listed in Schedule I may be discharged from a ship into any of the waters described in paragraphs 4(1)(a) to (c) if (a) the discharge is necessary for the purpose of saving lives or preventing the immediate loss of the ship; or (b) the discharge occurs as a result of an accident of navigation in which the ship or its equipment is damaged, unless the accident occurs as a result of an action that is outside the ordinary practice of seafarers. (2) A pollutant listed in Schedule I that is a noxious liquid substance as defined in section 2 of the Dangerous Chemicals and Noxious Liquid Substances Regulations may be discharged from a ship into the territorial sea and the portions of fishing zones 4 to 6 that are not within a shipping safety control zone if the discharge is made in accordance with Part IV of those Regulations. 6. by SOR/83-347 15 April, 1983 pursuant to sections 728 and 730 of the Canada Shipping Act Section 3 and Schedules I and II SOR/2002-276 17 July, 2002 pursuant to sections 656 and 657 of the Canada Shipping Act , into force on July 17, 2002.
